Agreement terms

The Contest is organized by Business Finland Oy – Visit Finland, P.O. Box 358, Porkkalankatu 1, 00180 Helsinki, Finland, business ID 0202317-7 (”Organizer”, “Visit Finland” or "Us" or "We”). In the United States the materials are provided by Business Finland USA, Inc. on behalf of Business Finland Oy. Visit Finland is a Finnish travel promotion organisation, a part of Business Finland and fully owned by the Finnish Government.

The purpose of the Contest is to promote travelling to Finland and Lapland by selecting winners who will make 4 days visit to Lapland with their partner.

The Contest is not organized or run by Instagram and Instagram does not sponsor, endorse or administer the Contest in any way and the Contest is in no way affiliated with Instagram. Participants release Instagram from all liability in connection with the Contest and agree to Instagram’s terms of use. This contest is void in any country where the local laws do not allow such contests.

No fee or purchase is required to enter the Contest or to win in the Contest.

By taking part in the Contest, you (“Participant” or “You”) confirm and agree on Your own behalf and on behalf of the partner You choose to travel with (“Partner”) that:

• You are at least 18 years old; and
• You are not an employee of Organizer or other company or partner of Organizer who takes part in the planning or implementation of the Contest or parts thereof or their family member; and
• You follow these Agreement terms (“Terms”) and any instructions given by the Organizer; and
• You will accept the decisions of the Organizer on the winners and on the prize.

Organizer reserves the right to disqualify a Participant at any time during the Contest period if the Participant does not meet the above requirements, has used fraudulent means to enter the Contest, has given false information or has otherwise acted in breach of these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT TAKE PART IN THE CONTEST.

1. Contest Timetable
You can participate during the Contest period which starts: 6 March 2024, 9 AM (GMT) and ends 19 June 2024, 12 PM (GMT).

During the Contest period, Organizer will select two winners from among all eligible Participants on

• 27 March,
• 17 April,
• 8 May,
• 22 May,
• 5 June, and
• 19 June 2024.

There are six selection rounds. So, dependent on Your answers, You can win six times.

2. How to participate
Participants must have an Instagram account to enter the Contest. Your account may not have any offensive or vulgar content. If Your account contains inappropriate content, as determined by Organizer in its sole discretion, You will be disqualified and You cannot not take part of in the Contest.

To participate in the Contest, follow these instructions:

1. follow @veskuthereindeer on Instagram.
2. Tag a friend (i.e. the Partner who would travel with You).
3. Tell Vesku where he is, based on his hints.
4. Tell Vesku which activity from the destination in question You would like to try the most and why.

Winners will be selected based on their answers to Vesku. We will evaluate Your answers and reserve the right, at Our sole discretion, to select the winners without giving any explanations or justifications.

3. The Prize
The prize is a visit to Finland for two persons within a period starting 17 June and ending 30 September 2024.

The prize INCLUDES:

• Finnair economy class flight tickets to Lapland in Finland from an airport where Finnair flies to, and which is nearest to Your home,
• Transportation to and from the airport in Finland
• Maximum 4 nights’ accommodation and two activities selected by Visit Finland at its absolute sole discretion,
• Transportation to activities in the visiting area and/or a rental car or other means to get around the visiting area as selected and instructed by Visit Finland.

The prize DOES NOT INCLUDE other costs related to the visit, e.g.:

• Travel or transportation to and from the airport in Your home country,
• Meals during the visit,
• Insurance coverage, including international travel, luggage, accident, health, and liability coverage,
• Passport, visa, and other travelling documents, 
• Any taxes arising from accepting the prize. Any such taxes will be the responsibility of the prize winner and his/her Partner.

The prize is personal and cannot be given, sold, or otherwise transferred to anyone else. The prize cannot be exchanged for cash, goods, or services.

4. Announcement of the winners
After selection, Organizer will notify the winners by a direct Instagram message. Only winners will be notified. If a winner does not reply within four days Organizer will select a new winner. Also, if the winner is found to be ineligible; has violated these Terms; declines to accept the prize or does not follow Organizer´s instructions, the prize may be awarded to an alternate winner, selected by Visit Finland. Each prize will only be awarded to a verified winner.

The winner's name and photograph may be published at the winner´s consent on veskuthereindeer Instagram account after one week of the selection.

5. Travel arrangements
Accommodation and/or services during the travel dates selected by the winner are subject to availability and must be confirmed by Visit Finland´s partners (the providers of the accommodation and/or services) as instructed by Visit Finland.

Note that if You change a confirmed booking of accommodation and/or services, the provider may charge You an extra fee.

Once Organizer has reached the winners and verified the eligibility of the winners, Organizer will provide necessary instructions for making travel, accommodation and service arrangements.  The winner shall inform Visit Finland without undue delay of any changes in his/her circumstances which could affect the arrangements.

The winner shall be responsible to take adequate measures to ensure his/her own safety and the comfort during the travel and the visit and particularly, during the activities in which he/she will participate.

The winner undertakes to arrange at his/her own expense an adequate insurance coverage for his/her property, as well as for any sickness or accidents that may be encountered by him/her during the travel. Adequate insurance coverage shall include international travel, luggage, accident, health, and liability coverage. The winner shall provide Visit Finland all applicable insurance certificates without undue delay and at least fourteen (14) days before the visit.

6. Code of Conduct
Automated entries to the Contest or answers to the Contest, including those submitted using any robot, script, macro or other automated service are not permitted and will be disqualified. Only eligible entries and answers received before the end of the Contest period will be valid in the Contest.

You will not by Your conduct or behaviour create any negative images or negative publicity that could harm the reputation or goodwill of Visit Finland or could negatively affect the purpose, value, and effectiveness of the Contest during the Contest and thereafter.

Any content posted, created or published by You in the social media in relation to the Contest shall portrait Finland and Visit Finland and the Contest positively and You agree to comply with all relevant instructions of Visit Finland.

You represent and warrant that Your answers in the Contest do not infringe or violate any copyrights, trademarks, trade names, design rights, contract rights, rights of publicity or privacy or other rights of any person or defame any person. If You use in Your answers any materials of any third party, You are responsible for obtaining all necessary rights, licenses, consents, and permissions from such third party.

You also represent and warrant that Your answers in the Contest are not abusive, threatening, obscene, defamatory, libelous or otherwise promote illegal activities or conduct; and are free of hate speech, discrimination or violence viruses, adware, spyware, worms or other malicious code.

If requested by Visit Finland You shall immediately delete or amend such content and posts in Your social media accounts, which Visit Finland considers to be in breach of these Terms.

7. Limitation of Liability

Each Participant shall bear full risk of any damage or accidents suffered by him/her because of taking part in the Contest, accepting the price, making the prize visit, and taking part in any activities.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISIT FINLAND SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR OTHER SIMILAR DAMAGES, OR LOSSES, ARISING OUT OF OR RELATING IN ANY WAY TO THESE TERMS, THE CONTEST, AND PRICE VISIT, WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT VISIT FINLAND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS SHALL AFFECT THE STATUTORY RIGHTS OF ANY CONSUMER OR EXCLUDE OR RESTRICT ANY LIABILITY RESULTING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF VISIT FINLAND OR FOR DEATH OR PERSONAL INJURY ARISING FROM ANY NEGLIGENCE OR FRAUD OF VISIT FINLAND.

Each Participant agrees to release and hold harmless Visit Finland, and each of its parent companies, affiliates, subsidiaries, officers, directors, representatives, agents and employees and partners, from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly from his/her 1) participation in the Contest; or 2) acceptance, or taking advantage of the prize; or 3) making the prize visit and taking part in any prize related activities.

A Party shall not be liable for the consequences resulting from delay or non-performance of a contractual obligation, if the non-performance was caused by or unreasonably affected by circumstances, which the Party was unable to influence and to consider at the time of concluding the Agreement, and the consequences of which the Party could not have reasonably avoided or overcome.

8. Data Protection
The personal information of the Participants will only be used to organize and manage the Contest and the prize visits in accordance with the current Finnish data protection legislation and the privacy notice available at: www.visitfinland.com/en/privacy-statement/. Personal information will not be used or disclosed for direct marketing.

9. Miscellaneous
This Agreement shall become effective once the Participant has Terms by entering the Contest and shall be in force until all rights and obligations related to this Agreement have been fulfilled.

Without prejudice to any other remedy, it may have against the other Party for breach or non-performance of the Agreement, either Party shall have the right to terminate the Agreement with immediate effect in case the other Party fails to perform its obligations under the Agreement.

Visit Finland reserves the right to cancel or modify the Contest and these Terms without prior notice. 

The Participant may not assign the Agreement or any of its rights or delegate its obligations under the Agreement without Visit Finland's prior written consent.

Nothing herein shall be construed to create any employment relationship, any partnership, or similar relationship or, to subject the Parties to any implied duties or obligations respecting the conduct of their affairs, which are not expressly stated herein.

If any provision of this Agreement or a part thereof is considered invalid, it shall not imply that the Agreement in its entirety is invalid and such invalid provision shall be replaced with a provision that, as far as possible, is consistent with the invalid provision.

This Agreement shall be governed by and construed in accordance with the laws of Finland excluding its choice of law principles.

The Parties shall try to resolve any dispute, controversy or claim arising out of or relating to this Agreement or the breach, termination, or validity thereof (“Dispute”) amicably by way of negotiation. In case the negotiations fail, the Dispute shall be settled in the Helsinki District Court.
